Request an emergency hearing (Form DR9)

Request an emergency hearing to resolve a dispute (like termination of tenancy and damages to property) between a landlord and tenant.

Use Form DR9: Request for Emergency Hearing to request an emergency hearing.

An emergency hearing may be considered only where there’s an immediate issue that can’t reasonably wait to be addressed at a regularly scheduled hearing.

Who can use this form

You can only use Form DR9 if you already applied to the director with Form J and haven’t already served the other party (tenant or landlord).

What you need to do

  1. Complete the form.
  2. Keep a copy of the form for your records.
  3. Take your completed application to Access Nova Scotia. Or send your completed form by email.
  4. The Residential Tenancies Program reviews your form and renders a decision. The decision is emailed to you (the program may contact you by phone if your email isn’t included in the request).
  5. If the Residential Tenancies Program provides you with a new Notice of Hearing, you need to formally serve (deliver) 1 of the copies of the completed application (including the new Notice of Hearing) to the respondent (the other party in the dispute).

How long it takes

It should take 2 weeks to receive a decision. It can take longer if more information is needed or if your application hasn’t been filled in correctly.

Cost

There is no cost to request an emergency hearing.

  • description of the issue and why an emergency hearing is requested
  • supporting information (like times, dates and any steps already taken to address the issue), if applicable
