Change of Sex Regulations

made under clauses 51(1)(fd) and (fe) of the

Vital Statistics Act

Citation

1     These regulations may be cited as the Change of Sex Regulations.


Definitions

2     In these regulations,

 

“Act” means the Vital Statistics Act;

 

“nurse practitioner” means nurse practitioner as defined in the Act or the equivalent under the legislation of a jurisdiction other than the Province;

 

“physician” means medical practitioner as defined in the Medical Act or the equivalent under the legislation of a jurisdiction other than the Province;

 

“psychologist” means registered psychologist as defined in the Psychology [Psychologists] Act or the equivalent under the legislation of a jurisdiction other than the Province;

 

“registered nurse” means registered nurse as defined in the Registered Nurses Act or the equivalent under the legislation of a jurisdiction other than the Province;

 

“social worker” means social worker as defined in the Social Workers Act or the equivalent under the legislation of a jurisdiction other than the Province.


Professions prescribed for statement in support of application

3     (1)    The following are prescribed as professions whose members are authorized to provide a written statement required by clause 25(1)(c) of the Act to support an application by a person who is at least 16 years old to change the sex shown on the person’s birth registration:

 

                (a)    physician;

 

                (b)    psychologist;

 

                (c)    nurse practitioner;

 

                (d)    registered nurse;

 

                (e)    social worker.

 

       (2)    The following are prescribed as professions whose members are authorized to provide a written statement required by clause 25(2)(c) of the Act to support an application by a person who is under the age of 16 to change the sex shown on the person’s birth registration:

 

                (a)    physician;

 

                (b)    psychologist.
