Citation

1        These regulations may be cited as the Animal Welfare Appeal Board Regulations.


Definitions

2        In these regulations,

 

“Act” means the Animal Protection Act;

 

“appeal” means an appeal of a seizure of an animal made to the Appeal Board under Section 37 of the Act;

 

“business day” means a day other than a Saturday, a Sunday or a holiday as defined in the Interpretation Act;

 

“notice of appeal” means a notice of appeal in the form prescribed by the Minister in accordance with subsection 37(1) of the Act.

3        A notice of appeal must be accompanied by a copy of the seizure of animal notice that is being appealed.


Fee for notice of appeal

4        (1)    The fee required to accompany a notice of appeal under subsection 37(3) of the Act is $257.52, plus any applicable taxes.

 

          (2)    The fee prescribed in subsection (1) is refunded if the Appeal Board decides the animal is to be returned to the owner or the custodian on behalf of the owner.


Incomplete notice of appeal

5        If an incomplete notice of appeal is submitted or any required accompanying documentation is missing, the Appeal Board may refuse to hear the appeal until the completed form or required documentation is provided.


Time period for notice of hearing appeal

6        The number of days within which notice of the time, date and place for a hearing of an appeal is required to be given under subsection 37(5) of the Act is 5 business days after the date the Chair of the Appeal Board receives notice of the appeal.


Time period for date of hearing appeal

7        The maximum number of days for fixing the date for hearing an appeal after the notice of appeal is received by the Chair of the Appeal Board required to be given under subsection 37(6) of the Act is 10 business days.


Time period for issuing decision

8        The number of days within which the decision of the Appeal Board is required to be issued under subsection 37(6) of the Act is 12 business days after the date the Chair of the Appeal Board receives notice of the appeal.


Time period for order of appeal board

9        (1)    The number of days within which oral notice of a decision in an appeal is required to be given under subsection 38(6) of the Act is 2 business days after the date of the hearing of the appeal.

 

          (2)    The number of days within which written reasons for a decision in an appeal is required to be given under subsection 38(6) of the Act is 10 business days after the date of the hearing of the appeal.
