Antigonish Wildlife Management Area Designation and Regulations

made under Section 113 of the
Wildlife Act
R.S.N.S. 1989, c. 504
O.I.C. 68-829 (October 1, 1968), N.S. Reg. 33/68

The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 26th day of September, A. D., 1968, pursuant to Section 161 of the Lands and Forests Act, is pleased to:

(a) declare that the area of Antigonish Harbour in the County of Antigonish, described in Schedule A and shown outlined in red on Schedule B attached to the report and recommendation shall no longer be a Bird Sanctuary and to revoke Order in Council No. 67-785 dated the 16th day of October, A.D., 1967, and the regulations thereto;

(b) declare that the area of Antigonish Harbour described in Schedule C and shown outlined in red on Schedule D, both attached to the report and recommendation be a Wildlife Management Area to be known as the Antigonish Wildlife Management Area;

(c) make regulations in the form set out in Schedule E attached to the report and recommendation, for the control of the Wildlife Management Area and the management of wildlife therein.


Schedule "A" - Antigonish Harbour Sanctuary

Beginning at a stake and stones placed on the west boundary line of lands of Angus Grant at William’s Point, in the County of Antigonish, Province of Nova Scotia. Said stake and stones being in a southerly direction, a distance of twenty-three feet from the mean high water mark of the south shore of Antigonish Harbour.

From thence to run by magnetic bearings in the year 1967, south one degree fifty-eight minutes east (S l° 58' E) along the western boundary of lands of said Angus Grant, a distance of two hundred and seventy-seven feet (277.0') to a stake and stones standing in the north boundary of the Canadian National Railways Main line from Antigonish to Sydney;

Thence in a southwesterly direction, following the various courses of the northern boundary of the said Canadian National Railways main line until it comes to a point three hundred and thirteen feet (313') more or less, west from the west face of the west concrete abutment of the railway bridge crossing Wright River, near the salt marshes at the head of Antigonish Harbour, said point being the centre line of an electric power transmission line;

Thence in a northerly direction following the centre line of the said electric power transmission line until it comes to a point on the south shoulder of the Landing Road, so called;

Thence following the southern shoulder of the said Landing Road in a northeasterly direction, to a stake and stones at the end of the said Landing Road at a point near the site of a wharf now demolished;

Thence from the last mentioned stake and stones, south thirty-nine degrees fifty-two minutes east (S 39° 52' E) a distance of one thousand, seven hundred and twenty-four and six-tenths feet (1,724.6') to the place of beginning.

Schedule "C" - Antigonish Harbour Game Management Area

Beginning at a blazed spruce tree on the South Shore of Antigonish Harbour, at William’s Point, said tree being the point of intersection of the boundary line between lands of Alex Kell and lands of Daniel MacGillivray and the Shore of Antigonish Harbour;

Thence in a South Westerly, Northerly and Westerly Direction following the various courses of the Shore of Antigonish Harbour until it comes to the Northern boundary of the Canadian National Railways main line from Sydney to Truro, immediately West of property occupied by George Garrior;

Thence following the Northern boundary of said Canadian National Railways main line until it comes to a point three hundred thirteen feet more or less West from the West face of the West concrete abutment of the Railway Bridge crossing Wright River near the Salt Marshes at the Head of Antigonish Harbour, said point being the centre line of an electric power transmission line;

Thence in a Northerly direction following the centre line of said electric power transmission line until it comes to a point on the South shoulder of the Landing Road, so called;

Thence, following the South shoulder of the said Landing Road in a North Easterly direction until it comes to the North Shore of Antigonish Harbour at the site of the old wharf, but including three inlets or lagoons adjacent to and North West of said Landing Road, the first being South West of property now or formerly of Thomas Young, the second being North East of property now or formerly of Thomas Young, and the third being to the West of land occupied by Vincent Benoit;

Thence from said point at the shore at the site of the old wharf in a North-Easterly direction following the various courses of the North West Shore of Antigonish Harbour until it comes to a blazed spruce tree near the shore on property now or formerly of Roderick Kennedy at Lanark;

Thence South 31° West to the place of beginning.

Schedule "E" - Regulations

1 In these regulations:

(a) "Act" means the Wildlife Act;

(b) "Wildlife Management Area" means any area of the Province declared to be a Wildlife Management Area pursuant to the Act.

2 Except as provided in these regulations, no person shall

(a) kill, take, hunt or pursue or attempt to kill or take any wild animal or bird; or

(b) have in his possession any firearm, trap, snare or poison or any wild animal or bird or the carcass or any part of any wild animal or bird within the limits of a Wildlife Management Area.

3 Anyone may carry a firearm, which has been sealed by a warden, within a Wildlife Management Area.

4 The Minister may by written authorization permit any person to enter a Wildlife Management Area at any time, except Sunday, to kill, take, hunt or capture any wild animal or bird.

5 The Minister may specify the terms and conditions upon which any permit is issued.

6 Where the Minister proposes to permit limited hunting or trapping within a Wildlife Management Area, he shall give public notice thereof in at least one edition of a newspaper having general circulation in the Province.

7 The Minister shall not authorize more than one hundred persons to enter a Wildlife Management Area on any one day for the purpose of hunting or trapping.

8 Every person except a warden or employee of the Department of Natural Resources, requesting authorization from the Minister to hunt in a Wildlife Management Area, shall

(a) apply for a permit at and enter a Wildlife Management Area through a check station established for that purpose by the Minister or his agent;

(b) possess any other license or permit that may be required by the Act or regulations;

(c) obtain and wear an identification marker issued by the Minister or his agent.

9 Every person authorized by the Minister to enter a Wildlife Management Area during a limited hunting or trapping period shall

(a) follow all instructions issued by the Minister or his agent with respect to hunting within the Wildlife Management Area;

(b) subject to these regulations, comply with the provisions of the Act and regulations;

(c) file a report as required by the Minister or his agent;

(d) turn over to an agent of the Minister any part of the carcass of any wild animal or bird killed or taken within the Wildlife Management Area as required by such agent.

10 (1) No person authorized to hunt within a Wildlife Management Area shall kill or take any wild animal or bird except in accordance with the written authorization referred to in regulation [Section] 4 hereof.

(2) Any bag limit specified by the Act or any regulation shall include any animal or bird taken pursuant to a permit issued by the Minister under these regulations.

11 No person shall allow any dog to run loose with the limits of a Wildlife Management Area.

12 (1) Except for swimming and fishing between the first day of May and the 30th day of September in any year, no person shall enter the Antigonish Wildlife Management Area without first having obtained a written permit from a warden.

(2) Any permit required by these regulations shall be carried by the holder thereof when in a Wildlife Management Area and be produced when requested by a warden.

(3) This regulation shall not apply to the owner of any lands within the limits of the Wildlife Management Area or to his employees.

13 The Governor in Council may appoint one or more persons to be wardens of a Wildlife Management Area.
