William E. DeGarthe Memorial Provincial Park Designation

made under Section 8 of the

Provincial Parks Act

R.S.N.S. 1989, c. 367

O.I.C. 88-839 (August 3, 1988), N.S. Reg. 178/88


The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 8th day of July, A.D., 1988, pursuant to Section 2 of Chapter 244 of the Revised Statutes of Nova Scotia, 1967, the Provincial Parks Act, is pleased to

 

       (a)    constitute all that area of land situate at Peggys Cove, in the County of Halifax, owned by Her Majesty the Queen in right of the Province of Nova Scotia, to be a Provincial Park, the said area of land being described in Schedule “A” and shown outlined in bold line on the copy of Department of Lands and Forests Plan No. P-094/84"A” marked Schedule “B”, both Schedules attached to and forming part of the report and recommendation; and

 

       (b)    declare that the Park shall be known by the name of “William E. DeGarthe Memorial Provincial Park”.


Schedule “A”


All that certain lot, piece or parcel of land situate, lying and being at Peggys Cove, in the County of Halifax, Province of Nova Scotia as shown on a plan of survey (Field Plot No. P-094/84 “A”), and filed in the Department of Lands and Forests Office Dartmouth, the said parcel of land being more particularly described as follows:


Beginning at a survey marker placed on the southeastern boundary of land now or formerly of Donald P. Crooks, said point being situate (by grid bearings referenced to the Nova Scotia 3° Modified Transverse Mercator Projection, Zone 5, Central Meridian 64° 30' west longitude) N 48° 47' 09" E, a distance of 1,140.69' from Nova Scotia Co-ordinate Monument No. 10189 having co-ordinate values (Northing 16,168,465.03', Easting 18,196,541.48');


Thence (from the place of beginning) following the southeastern boundary of land of Donald P. Crooks and Edward Morash, N 51° 39' 26" E, a distance of 110.79' to a point;


Thence along the southeastern boundary of lands of Edward Morash, N 51° 39' 26"E, a distance of 3.47' to a point;


Thence N 75° 57' 32" E, a distance of 23.00' to a point being on a curve to the right with a radius of 102.34' and arc distance of 63.51' to a point of curve said point of curve being

S 06° 28' 14" W, a distance 62.49' from [the] last mentioned point;


Thence S 24° 14' 52" W, a distance of 80.92' to a point;


Thence N 65° 45' 08" W, a distance of 23.00' to a survey marker;


Thence N 29° 30' 24" W, a distance of 16.48' to a point;


Thence N 29° 30' 24" W, a distance of 7.48' to a survey marker;


Thence N 53° 12' 01" W, a distance of 3.03' to a point;


Thence N 53° 12' 01" W, a distance of 45.57' to the place of beginning;


The above parcel of land containing 7,635 square feet more or less including a 10' wide easement.


Subject to a 10' wide underground water line easement to land now or formerly of Agnes DeGarthe. Beginning at a point located on a bearing of S 53° 12' 01" E, a distance of 45.57' from a survey marker located on the southeastern boundary of land now or formerly [of] Donald P. Crooks;


Thence N 68° 12' 47" E, a distance of 32.09' to a point;


Thence S 24° 14' 52"W, a distance of 14.40' to a point;


Thence S 68° 12' 47" W, a distance of 19.14' to a point;


Thence N 29° 30'24" W, a distance of 7.48' to a survey marker;


Thence N 53° 12' 01" W, a distance of 3.03' to the place of beginning.


The above parcel of land containing 251.5 square feet more or less.
