Regulations Respecting Part-time Judges of the Family Court

made under Section 5A of the
Family Court Act

1 These regulations may be cited as the "Regulations Respecting Part-time Judges of the Family Court".

2 In these regulations, "part-time judge" means a judge who is retired and is appointed in office as a judge by the Chief Judge pursuant to Section 5A of the Act.

3 A part-time judge may, subject to the annual approval of the Chief Judge, continue in office as a part-time judge until the part-time judge attains the age of 75 years.

4 A part-time judge shall have the jurisdiction, power and authority of a judge and shall exercise that jurisdiction, power and authority at the request of the Chief Judge.

5 A part-time judge shall be remunerated according to the per-diem rate from time to time determined by the tribunal appointed pursuant to Section 21A of Chapter 238 of the Revised Statutes of Nova Scotia, 1989, the Provincial Court Act.

6 The services of a part-time judge provided pursuant to these regulations shall not be credited as service for the purpose of

(a) the Public Service Superannuation Act; or

(b) the Public Service Award.

7 These regulations do not apply to a retired judge who has been reinstated as a practicing member of the Nova Scotia Barristers' Society
