Ballantyne Cove Beach Designation

made under Section 5 of the

Beaches Act

R.S.N.S. 1989, c. 32

O.I.C. 75-1281 (November 18, 1975), N.S. Reg. 159/75


The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 23rd day of October, A.D., 1975, pursuant to subsection (1) of Section 5 of Chapter 6 of the Statutes of Nova Scotia, 1975, the Beaches Preservation and Protection Act, is pleased to designate as a beach an area of land lying landward from the mean high water mark of Ballantyne Cove Beach, in the County of Antigonish, Province of Nova Scotia, as shown outlined in red on the copy of Crown Land Records Office Plan No. E-10-13, and described in Schedule “A”, both attached to and forming part of the report and recommendation.



Schedule “A”


All that certain area of land lying landward from the mean high water mark of Ballantyne Cove Beach, in the County of Antigonish, Province of Nova Scotia as shown outlined in red on Plan No. E-10-13 filed in the Crown Land Records office, Halifax and being more particularly described as follows:


Commencing at N.S.C.M. 11457 as shown on Plan E-10-13 on file in the Crown Land Records office, Department of Lands and Forests, Halifax;


From thence (by grid bearings) N 49° 41' 10" E, 3096.68' to point “A”, said point “A” lying on Ballantyne Cove Wharf as indicated on the afore-mentioned Plan No. E-10-13;


Thence N 34° 59' 02" E, 683.21' to an iron post cemented in rock, said post lying landward 12.0' from the intersection of the mean high water mark with the toe of the cliff;


Thence seaward 12.0' to a point, said point being the intersection of the mean high water mark with the toe of the cliff, said point also being the Place of Beginning as indicated on the aforementioned Plan No. E-10-13;


Thence westerly continuing along the toe of the cliff to a point, said point lying N 0° 00' 00" E, 116' more or less from an iron post;


Thence S 0° 00' 00" W, 116' more or less to an iron post, said iron post lying N 59° 11' 11" W, 513.04' from point “A” as indicated on the aforementioned Plan No. E-10-13, said iron post also lying on the landward face of the wooden breakwater, said iron post also lying landward 39.0' from the mean high water mark;


Thence south westerly at right angles to the face of the breakwater 8.0' to the brook side face of the breakwater;


Thence seaward following the several courses of the brook side face of the breakwater to the mean high water mark;


Thence easterly following the mean high water mark as indicated on the aforementioned Plan No. E-10-13 to the place of beginning;


All bearings being 3° Modified Transverse Mercator Grid Bearings, Central Meridian 61° 30' west longitude.
