St. Croix Marsh Body Boundary Variation Order

made under Section 13 of the

Agricultural Marshland Conservation Act

S.N.S. 2000, c. 22

N.S. Reg. 50/2009 (February 24, 2009)


       Whereas the St. Croix Marsh Body was incorporated on June 21, 1950;


       And whereas the lands described in the Certificate of Incorporation for the St. Croix Marsh Body are shown in the Plan of Works St. Croix NS 38/6, Sheets 1 and 2 of 2;


       And whereas the Agricultural Marshland Conservation Commission recommends that the boundary of the marshland section for the St. Croix Marsh Body is incorporated be varied so as to exclude from the marshland section Lots 17 and 19 on Plan NS 38/6, Sheets 1 and 2 of 2 as shown on the Plan of Works St. Croix, attached hereto as Schedule “A”;


       And whereas a resolution requesting the variation was passed at a special meeting of the members of the St. Croix Marsh Body by a vote of not fewer than two thirds of the members of the St. Croix Marsh Body present at the meeting and the owners of not less than two thirds of the marshland proposed to be excluded favour of the variation; 


       Therefore, I, Mark Parent, Minister of Agriculture, pursuant to Section 13 of Chapter 22 of the Acts of 2000, the Agricultural Marshland Conservation Act, vary the boundary of the marshland section for which the St. Croix Marsh Body is incorporated by excluding from the marshland section Lots 17 and 19 on Plan NS 38/6, Sheets 1 and 2 of 2 as shown on the Plan of Works St. Croix attached hereto as Schedule “A”;


       In accordance with subsection 13(3), the following is a description of the area to be excluded from the marshland section for which the St. Croix Marsh Body is incorporated:


       All that certain piece and parcel of dykeland shown on Plan NS 38/6, Sheets 1 and 2 of 2 of Plan of Works St. Croix containing Lot 17, starting at an iron pin on the north end of the dyke then following the tidal side of the dyke right-of-way to an iron pin on the south end of the dyke, then following the high water mark at elevation 26.0 feet to place of beginning; and


       All that certain piece and parcel of dykeland shown on Plan NS 38/6, Sheets 1 and 2 of 2 of Plan of Works St. Croix containing Lot 19, starting at an iron pin on the west end of the dyke then following the tidal side of the dyke right-of-way to an iron pin on the east end of the dyke, then following the high water mark at elevation 26.0 feet to place of beginning.

Resolution of the St. Croix Marsh Body

Made at a Special Meeting held

the 27th day of August, A.D., 2008


       Whereas it is the intention of not fewer than two-thirds of the members of the NS 38

St. Croix Marsh Body that the boundaries of the St. Croix Marsh marshland section described in the Certificate of Incorporation of the NS 38 St. Croix Marsh Body be varied to delete as marshland the lands described in the Certification [Certificate] of Incorporation as Lot 17 George Spence and Lot 19 CL/PL Smith for the St. Croix Marsh marshland section;


       Be it resolved that the Minister of Agriculture of the Province of Nova Scotia is respectfully requested to approve a variation of the boundaries of the St. Croix Marsh marshland section to exclude as marshland the lands described as Lots 17 and 19 in the Certificate of Incorporation for the NS 38 St. Croix Marsh Body.

 

Certified to be a true copy of a resolution passed by 66 percent of the members of the NS 38 St. Croix Marsh Body owning land within the boundaries of the St. Croix Marsh marshland section who are resident in the province of Nova Scotia and who own not less than percent of the marshland within the St. Croix Marsh marshland section [sic].
