Crown Lands Act

Text of Order:

        The Governor in Council on the report and recommendation of the Minister of Natural Resources dated January 5, 2016, and pursuant to subsection 7(c) and clauses 16(1)(a) and (b) of Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, is pleased to approve the Minister of Natural Resources:

        a)         issuing a grant or deed to convey a parcel of Crown lands containing approximately 24 hectares (59.3 acres), with the exact acreage to be determined by survey, located at Ingramport, Halifax County, and shown outlined in bold and shaded grey on the plan marked Schedule “A”, which is attached to and forms part of the Report and Recommendation, to Scotian Materials Limited, or its approved successors and assigns;

        b)         accepting from Scotian Materials Limited, or its approved successors and assigns, three parcels of private lands containing approximately 96 hectares (237.2 acres), with the exact acreage to be determined by survey, located at Ingramport and Fall River, Halifax County, shown outlined in bold on the plans marked Schedule “A” and Schedule “B”, which are attached to and form part of the Report and Recommendation, subject to the condition that Scotian Materials Limited, or its approved successors and assigns, be able to certify title to the land in a manner deemed sufficient by the Department of Justice;

        c)         granting a right of way, with respect to Crown lands at Ingramport, Halifax County, shown outlined in bold on the plan marked Schedule “C”, which is attached to and forms part of the Report and Recommendation, to Scotian Materials Limited, a body corporate having its registered office at Dartmouth, Nova Scotia, or its approved successors and assigns for the consideration of $3,738.91 per hectare, with the exact amount to be determined by survey plus any legal, appraisal, survey, or other costs associated with the transaction; and

        d)         executing such documents as may be necessary to achieve the purposes of this Order.
