Cabot’s Landing Provincial Park Designation

made under Section 8 of the

Provincial Parks Act

R.S.N.S. 1989, c. 367

O.I.C. 74-1378 (December 19, 1974), N.S. Reg. 123/74


The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 27th day of November, A.D., 1974, pursuant to the provisions of Section 2 of Chapter 244 of the Revised Statutes of Nova Scotia, 1967, the Provincial Park Act, is pleased to:

 

                (a)    constitute all that area of land including land covered with water owned by Her Majesty in right of the Province of Nova Scotia and situate at or near Sugar Loaf, in the County of Victoria, to be a Provincial Park, said area of land being included within the boundaries of the lands described in Schedule “A” and shown outlined on the Plan of Survey marked Schedule “B”, both Schedules attached to and forming part of the report and recommendation;

 

                (b)    declare the name by which the park shall be known as “Cabot’s Landing Provincial Park”.

Cabot’s Landing Provincial Park


All that certain lot, piece or parcel of land situate, lying and being at or near Sugar Loaf, County of Victoria, Province of Nova Scotia as the same is shown on Plan E-5-36 recorded in the Crown Land Registry office, Department of Lands and Forests, Halifax and being more particularly described as follows:


Beginning at a Crown Land Iron Post (C.L.I.P.) marked V2125 set on the southeastern boundary of the main highway leading from the Cabot Trail to Bay St. Lawrence and the most northerly corner of lands now or formerly owned by Samuel Holmes;


Thence north thirty-four degrees forty-two minutes forty-two seconds east (N 34° 42' 42" E) along the southeastern boundary of said main highway leading from the Cabot Trail to Bay St. Lawrence, distant six hundred seventy-nine decimal thirty-nine (679.39) feet to a C.L.I.P. marked V2113;


Thence south thirty-five degrees twenty-three minutes east (S 35° 23' 00" E) along the western boundary of lands now or formerly owned by David F. Wilkie, distant two hundred fourteen decimal fifty-four (214.54) feet to a C.L.I.P. marked V2114;


Thence north fifty-four degrees twenty-seven minutes thirty seconds east (N 54° 27' 30" E) along the southern boundary of lands now or formerly owned by David F. Wilkie, distant sixty-nine decimal thirty-six (69.36) feet to a C.L.I.P. marked V2115;


Thence south thirty degrees forty-eight minutes twelve seconds east (S 30° 48' 12" E) along the western boundary of lands now or formerly owned by Mrs. Margaret MacKinnon and lands now or formerly owned by Murdock Hollingsworth, distant one hundred sixty-two decimal ninety-six (162.96) feet to a C.L.I.P. marked V2116;


Thence north fifty-nine degrees twelve minutes twelve seconds east (N 59° 12' 12" E) along the southern boundary of lands now or formerly owned by Murdock Hollingsworth, distant one hundred fourteen decimal eighty-seven (114.87) feet to a C.L.I.P. marked V2117 set on the western boundary of the road leading to Cabot Landing;


Thence south twenty-one degrees fifty-two minutes eighteen seconds east (S 21° 52' 18" E) along the western boundary of said road leading to Cabot Landing, distant two hundred forty decimal sixty-eight (240.68) feet to a C.L.I.P. marked V2118;


Thence south twenty-three degrees forty-nine minutes twelve seconds east (S 23° 49' 12" E) along the western boundary of the said road leading to Cabot Landing, distant two hundred thirty-three decimal fifty-seven (233.57) feet to a C.L.I.P. marked V2119;


Thence south thirty-eight degrees thirty minutes forty-two seconds east (S 38° 30' 42" E) along the western boundary of the said road leading to Cabot Landing, distant two hundred forty-seven decimal twenty-four (247.24) feet to a C.L.I.P. marked V2120;


Thence south thirty-six degrees thirty-eight minutes twenty-two seconds east (S 36° 38' 22" E) along the western boundary of said road leading to Cabot Landing, distant one hundred twenty-seven decimal seventy-six (127.76) feet to a C.L.I.P. marked V2177;


Thence north fifty-four degrees thirty-six minutes east (N 54° 36' 00" E) crossing the said road leading to Cabot Landing, distant twenty decimal zero (20.0) feet to a C.L.I.P. marked V2175 set on the western boundary of lands now or formerly owned by Bruce McNewly;


Thence south thirty-six degrees thirty-two minutes forty-eight seconds east (S 36° 32' 48" E) along the western boundary of said lands now or formerly owned by Bruce McNewly, distant sixty-nine decimal forty-eight (69.48) feet to a C.L.I.P. marked V2176;


Thence south thirty-six degrees thirty-two minutes forty-eight seconds east (S 36° 32' 48" E) along the western boundary of said lands now or formerly owned by Bruce McNewly to the mean high water mark of Aspy Bay;


Thence southwesterly along the mean high water mark of Aspy Bay to a point being south forty-two degrees forty-one minutes east (S 42° 41' 00" E) from C.L.I.P. marked V2124, and

on the most easterly corner of said lands now or formerly owned by Samuel Holmes;


Thence north forty-two degrees forty-one minutes west (N 42° 41' 00" W) along the northeastern boundary of said lands now or formerly owned by Samuel Holmes to a C.L.I.P. marked V2124;


Thence north forty-two degrees forty-one minutes west (N 42° 41' 00" W) along the northeastern boundary of said lands now or formerly owned by Samuel Holmes, distant one thousand three hundred thirty-two decimal sixty-five (1332.65) feet to the place of beginning.


The above land containing an area of seventeen decimal one (17.1) acres more or less. All bearings are astronomic.
