Delegation of General Powers to the Hatching Egg Farmers

of Nova Scotia Regulations

made under subsection 6(2) of the

Natural Products Act

R.S.N.S. 1989, c. 308

Citation

1     These regulations may be cited as the Delegation of General Powers to the Hatching Egg Farmers of Nova Scotia Regulations.


Definitions

2     In these regulations,

 

“Act” means the Natural Products Act;

 

“Commodity Board” means the Hatching Egg Farmers of Nova Scotia, a body corporate constituted under the Plan;

 

“Plan” means the Hatching Egg Marketing Plan made by the Council under Section 11 of the Act;

 

“regulations” means regulations made under the Act with respect to producing or marketing hatching eggs or chicks.


General powers delegated to Commodity Board

3     The Council delegates power to the Commodity Board to do all of the following:

 

                (a)    investigate the cost of producing, distributing and transporting hatching eggs and chicks, prices, price spreads, trade practices, methods of financing, management, grading, policies and other matters relating to the marketing or production of hatching eggs or chicks (clause 6(1)(b) of the Act);

 

                (b)    do any acts, make any orders and issue any directions that are necessary to enforce the Act, the Plan or the regulations (clause 6(1)(c) of the Act);

 

                (c)    stimulate, increase and improve the marketing or production of hatching eggs or chicks for the purpose of carrying out the Plan (clause 6(1)(f) of the Act);

 

                (d)    determine the price or prices at which hatching eggs or chicks may be bought or sold in the regulated area (clause 6(1)(g) of the Act);

 

                (e)    exempt from the Plan or the regulations a person or class of persons who produce or market hatching eggs or chicks, or who produce or market a class, variety or grade of hatching eggs or chicks (clause 6(1)(h) of the Act);

 

                (f)    require persons who produce or market hatching eggs or chicks to

 

                         (i)     register their names, addresses and occupations with the Commodity Board (clause 6(1)(i) of the Act), and 

                         

                        (ii)      furnish any additional information relating to the production or marketing of hatching eggs or chicks determined by the Commodity Board, including the quantity produced or marketed by them (clause 6(1)(i) of the Act);

 

                (g)    inspect, during normal business hours only, the books and premises of persons who produce or market hatching eggs or chicks (clause 6(1)(i) of the Act);

 

                (h)    require, by order, a person who produces or markets hatching eggs or chicks to deduct from their payment to another person who produces or markets hatching eggs or chicks an amount payable to the Commodity Board by that other person, and to remit that amount to the Commodity Board (clause 6(1)(j) of the Act);

 

                (i)     require the person in charge of any vehicle thought to be conveying hatching eggs or chicks to stop the vehicle and to permit any person appointed by the Council for the purpose to inspect the vehicle and its contents (clause 6(1)(k) of the Act);

 

                (j)     co-operate with any board or agency established under any federal Act or any provincial Act to market or promote, facilitate, control, regulate or prohibit the marketing or production of hatching eggs or chicks and to act conjointly with any such board or agency (clause 6(1)(l) of the Act);

 

                (k)    co-operate and act conjointly with other marketing boards, agencies, organizations or corporations in the Province for the purpose of sharing information or resources (clause 6(1)(l) of the Act);

 

                (l)     prohibit any person from marketing or producing hatching eggs or chicks except under the authority of a licence issued by the Commodity Board (clause 6(1)(m) of the Act);

 

                (m)   require the furnishing of security or proof of financial responsibility by any person that markets or produces hatching eggs or chicks (clause 6(1)(n) of the Act).


Commodity Board authorized to borrow

4     The Council authorizes the Commodity Board to borrow money for the purposes of carrying out any provision of the Plan (clause 6(1)(e) of the Act).


Council supervision of exercise of powers

5     The exercise by the Commodity Board of any power delegated by Section 3 or authority granted by Section 4 is subject to the supervision of the Council.


Council retains authority to exercise powers

6     Despite the delegation of powers to the Commodity Board in Section 3 and the granting of authority to the Commodity Board in Section 4, if the Commodity Board refuses to act or is unable to act, the Council retains the authority to exercise the powers it has delegated and the authority it has granted to the Commodity Board.
