Mahoney’s Beach Designation

made under subsection 5(1) of the

Beaches Act

R.S.N.S. 1989, c. 32

O.I.C. 76-554 (May 11, 1976), N.S. Reg. 132/76


The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 7th day of May, A.D., 1976, pursuant to subsection (1) of Section 5 of the Beaches Preservation and Protection Act, Chapter 6 of the Statutes of Nova Scotia, 1975, is pleased to designate as a beach an area of land lying landward from the mean high watermark of Mahoney’s Beach, in the County of Antigonish, Province of Nova Scotia, as shown on the copy of Crown Land Records Office Plan No. E-5-58 and described in Schedule “A”, both attached to and forming part of the report and recommendation.



Schedule “A”


All that certain area of land lying landward from the mean high watermark of Mahoney’s Beach, in the County of Antigonish, Province of Nova Scotia as shown on Plan No. E-5-58 filed in the Crown Land Records Office, and being more particularly described as follows:


Beginning at an iron pipe placed on the east side of the road leading to Mahoney’s Beach and designated as Point “A” on said Plan E-5-38;


From thence (by astronomic bearings referenced to meridian 61° 30' west longitude) south eleven degrees twenty-five minutes west, a distance of two hundred nineteen decimal seven feet to an iron pipe situate on or near the mean high watermark of Mahoney’s Beach, said iron pipe designated as Point “B” on Plan E-5-58;


Thence southerly, easterly and northerly following the various courses of the mean high watermark of Mahoney’s Beach to a point situate south forty-five degrees forty-eight minutes east, a distance of one hundred fifty feet more or less from place of beginning, the said point being designated as Point “C” on said Plan E-3-58;


Thence north forty-five degrees forty-eight minutes west, one hundred fifty feet more or less to the place of beginning.
