Point Michaud Beach Designation

made under subsection 5(1) of the

Beaches Act

R.S.N.S. 1989, c. 32

O.I.C. 76-1153 (October 5, 1976), N.S. Reg. 148/76


The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 30th day of August, A.D., 1976, pursuant to Section 5(1) of Chapter 6 of the Statutes of Nova Scotia, 1975, the Beaches Preservation and Protection Act, is pleased to designate as a beach an area of land lying landward from the mean high watermark of Point Michaud Beach, in the County of Richmond, Province of Nova Scotia, as shown outlined in red on the copy of Crown Land Records Office Plan No. E-7-80, marked Schedule “B”, and described in Schedule “A”, both attached to and forming part of the report and recommendation.


Schedule “‘ A”

 

All that certain area of land lying landward from the mean high watermark of Point Michaud Beach, in the County of Richmond, Province of Nova Scotia as shown outlined in red on the copy of Crown Land Records Office Plan No. E-7-80, attached hereto and marked Schedule “B” and being more particularly described as follows:

 

Beginning at Crown Land iron post #R3346 having co-ordinates (northing 16, 563, 917.30 easting 1, 201, 409.64) referred to the Nova Scotia Three Degree Transverse Mercator Projection Zone 4, Central Meridian 61° 30' West Longitude, said post situated on lands now or formerly of Jeffrey Landry and being one hundred and sixty feet more or less from the shore of the Atlantic Ocean;

 

From thence (by grid bearings) north seventy-two degrees, one minute thirty-seven seconds east, nine hundred eighty-nine decimal twenty-four feet to Crown Land iron post #R3345 having coordinates (N 16, 564, 222.58, E 1, 202, 350.61);

 

Thence north eighty-two degrees twenty-nine minutes, fifteen seconds east, one thousand three hundred forty-three decimal seventeen feet to Crown Land Iron Post #R3344 having coordinates (N 16, 564, 398.19, E 1, 203, 682.25);

 

Thence north seventy-seven degrees, nineteen minutes, twenty-three seconds east, one thousand six hundred and thirty-six decimal zero eight feet to iron post #R3343 having coordinates (N 16, 564, 757.23, E 1, 205, 278.45);

 

Thence north sixty-eight degrees, fifty-eight minutes fifty-five seconds east, nine hundred thirty-nine decimal zero three feet to Crown Land iron post #R3342 having coordinates (N 16, 565, 094.02, E l, 206, 155.00);

 

Thence north thirty-nine degrees, one minute forty-three seconds east, seven hundred fourteen decimal sixty-three feet to Crown Land iron post #R3341 having coordinates (N 16, 565, 649.17, E 1, 206, 605.01);

 

Thence north twenty-two degrees three minutes forty-four seconds east one thousand eleven decimal eighty-one feet to Crown Land iron post #R3340 having coordinates (N 16, 566, 586.89, E 1, 206, 985.06);

 

Thence north thirteen degrees forty-five minutes forty-six seconds east, one thousand one hundred twenty-two decimal seventeen feet to Crown Land iron post #R3339 having coordinates (N 16, 567, 676.84, E 1, 207, 252.03);

 

Thence north fifty degrees thirty-four minutes forty-nine seconds east, two thousand three hundred six decimal sixty-five feet to Crown Land iron post #R3338 having co-ordinates (N 16, 569, 141.55, E 1, 209, 033.96);

 

Thence north seventy-one degrees three minutes thirty-two seconds east, nine hundred eighty-six decimal eighteen feet to Crown Land iron post #R3337 having coordinates (N 16, 569, 461.66, E 1, 209, 966.74);

 

Thence south eighteen degrees twelve minutes fifty-eight seconds east, eleven thousand thirteen decimal sixty-two feet to a point situated in the waters of the Atlantic Ocean, said point having coordinates (N 16, 559, 000.00, E 1,213,409.64);

 

Thence due west, twelve thousand feet to a point situated in the waters of the Atlantic Ocean, said point having coordinates (N 16,559.000.00, E 1, 201, 409.64);

 

Thence due north four thousand nine hundred seventeen decimal thirty-three feet to the place of beginning.

 

Excepting and reserving from the above described area of land all the portion thereof lying seaward from the mean high watermark.
