Municipal Planning Strategy and Land Use By-law Amendment Order for the Bedford West 1 and 12 Special Planning Area

made under Section 16 of the

Housing in the Halifax Regional Municipality Act

S.N.S. 2021, c. 21

N.S. Reg. 126/2023 (effective July 4, 2023)



Whereas the Bedford West 1 and 12 Special Planning Area Order, N.S. Reg. 55/2022, was made on March 24, 2022, and designated the Bedford West 1 and 12 Special Planning Area;


And whereas, on the recommendation of the Executive Panel on Housing in the Halifax Regional Municipality, a Ministerial Order, N.S. Reg. 115/2022, was made on June 16, 2022, amending the municipal planning strategy applicable to the Bedford West 1 and 12 Special Planning Area (respecting the Regional Municipal Planning Strategy);


Whereas the Executive Panel on Housing in the Halifax Regional Municipality has recommended amendments to the Bedford Land Use By-law;


And whereas I am satisfied that the recommended amendments are necessary to advance the purpose of the Housing in the Halifax Regional Municipality Act;


Therefore, I order the following:

 

The Bedford Land Use By-law is amended by adding the text shown below in bold immediately following Section 5 of Part 4: Uses Permitted by Development Agreement:

 

                   6.       Notwithstanding any other provisions of this By-law, within the lands designated as a Special Planning Area, early tree removal, blasting, and earthworks may be considered, subject to the provisions of a development agreement in accordance with policy G-11A of the Regional Municipal Planning Strategy.


This order is effective on and after the date of this order.
