Smiley’s Provincial Park Designation

made under Section 8 of the

Provincial Parks Act

R.S.N.S. 1989, c. 367

O.I.C. 71-1071 (October 19, 1971), N.S. Reg. 93/71


The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 12th day of October, A.D., 1971, pursuant to the provisions of Section 2 of the Provincial Parks Act, Chapter 244, R.S.N.S. 1967, is pleased to

 

                (a)    constitute all that area of land including land covered. with water owned by Her Majesty in right of the Province of Nova Scotia and situate at Newport in the County of Hants, Province of Nova Scotia, to be a provincial park, said area of land being included within the boundaries of the lands described in Schedule “A” attached to the report and recommendation, and shown outlined on the Plan of Survey marked Schedule “B” attached to the report and recommendation; and

 

                (b)    declare the name by which the park shall be known as “Smiley’s Provincial Park” .

Smiley’s Provincial Park

 

All those certain lots, pieces or parcels of land situate, lying and being near Newport in the County of Hants, Province of Nova Scotia, shown as Lot “A” and Lot “B” on plan E-8-21 recorded in the Crown Land Records Office, Department of Lands and Forests, Halifax and being more particularly described as follows:


Lot “A”

Beginning at a Crown Land iron post placed where the westerly boundary of the paved highway leading from Newport Corner to Upper Newport intersects the northerly edge of Meander River;


From thence by magnetic bearings as in the year 1968, northerly following the westerly boundary of the aforementioned highway to a Crown Land iron post, said post being north three degrees thirty-eight minutes west, four hundred forty-five decimal forty-five feet from the place of beginning;


Thence north fifty-nine degrees forty minutes west, four hundred seventy-nine decimal eighty-two feet to a Crown Land iron post;


Thence south fifty-nine degrees five minutes west, fifty-three decimal forty-six feet to a Crown Land iron post;


Thence north thirty-one degrees fifteen minutes west, ninety-three decimal seventy-two feet to a point;


Thence north twenty-four degrees five minutes west, seventy-four decimal fifty-eight feet to a point;


Thence north ten degrees zero minutes west, one hundred seventeen decimal forty-eight feet to a point;


Thence north fifty-three degrees thirty minutes west, fifty-six decimal ten feet to a point;


Thence north fifty-seven degrees forty minutes west, one hundred forty-seven decimal forty-eight feet to a point;


Thence north eighty-three degrees thirty minutes west, sixty-two decimal zero four feet to a point;


Thence south fifty-seven degrees thirty minutes west, one hundred twenty-four decimal seventy-four feet to a point;


Thence south thirty-eight degrees forty-five minutes west, sixty-six decimal zero feet to a point;.


Thence south one degree fifty minutes west, one hundred seventy-three decimal fifty-eight feet to a point;


Thence south eighty-one degrees fifty minutes west, thirty-five decimal sixty-four feet to a point;


Thence south eighty-two degrees forty minutes west, sixty-one decimal thirty-eight feet to a point;


Thence south eighty-four degrees thirty-five minutes west, one hundred eighty-two decimal sixteen feet to a Crown Land iron post;


Thence south fifty-six degrees thirty minutes west, one hundred six decimal twenty-six feet to a Crown Land iron post;


Thence north twelve degrees six minutes east, four hundred fifty-nine decimal thirty-six feet to a Crown Land iron post;


Thence in a westerly direction following the courses of a fence to a Crown Land iron post; said post being north seventy four degrees fourteen minutes west, nine hundred sixty-six decimal twenty-four feet from the last aforementioned post;


Thence south eighty-six degrees five minutes west, one thousand six hundred twenty-seven decimal fifty-six feet to a Crown Land iron post;


Thence south seven degrees zero minutes west, seven hundred eighty decimal twelve feet to a Crown Land iron post;


Thence south seven degrees zero minutes west, one thousand fifty-one decimal thirty-eight feet to a Crown Land iron post situate on the northerly edge of Meander River;


Thence in an easterly direction following the several courses of the northerly edge of Meander River a distance of four thousand eight hundred feet more or less to the place of beginning, area described herein containing 100 acres more or less;


Lot “B”

Beginning at a point situated near the southerly edge of Meander River and being south eighty-five degrees twenty-one minutes east, seven hundred twenty-four decimal twelve feet from the Crown Land iron post marking the extreme southwesterly corner of Lot “A”;


From thence north eighty-six degrees zero minutes east, one hundred nineteen decimal forty-six feet to a point;


Thence south eighty-four degrees zero minutes east, one hundred seven decimal fifty-eight feet to a point;


Thence north eighty-three degrees twenty-five minutes east, two hundred nineteen decimal twelve feet to a point on the southerly edge of Meander River;


Thence westerly and southerly following the southerly boundary of Meander River to the place of beginning containing 1.2 acres more or less.
