Homeowners' Incentive Regulations made under Section 10 of the
Homeowners' Incentive Act

1 In these regulations
(a) "Act" means the Homeowners' Incentive Act;
(b) "condominium dwelling" means a unit as defined in the Condominium Act that provides housing accommodation for a single family within the confines of the unit and together therewith the common elements as defined in the Condominium Act that are appurtenant to the unit and form part of the building in which the unit is located;
(c) "rowhouse dwelling" means a unit within a separate and detached building permanently erected on land within Nova Scotia which building consists of three or more self-contained units within the confines of the building, each of which provides housing accommodation for a single family within the confines of the unit;
(d) "mobile home" means a new single family dwelling designed to be transported on its own chassis and wheel system to a lot of land where it has been affixed to produce a single-family house for year-round habitation.

2 (1) The following dwellings are designated as housing units for the purposes of the Act:
(a) a condominium dwelling;
(b) a rowhouse dwelling;
(c) any dwelling occupied by the owner thereof as his principal or primary place of residence;

(2) No dwelling shall constitute a housing unit for the purposes of the Act or these regulations unless the owner thereof occupies the dwelling as his principal or primary place of residence.

3 For the purposes of subsection (5) of Section 4 of the Act, a duplex shall be deemed to include a condominium dwelling, and a rowhouse dwelling.
4 These regulations shall be deemed in full force and effect on and from April 1, 1972.
