Port Morien Beach Designation

made under subsection 5(1) of the

Beaches Act

R.S.N.S. 1989, c. 32

O.I.C. 85-1070 (October 1, 1985), N.S. Reg. 164/85


The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 31st day of July, A.D., 1985, pursuant to Section 5(1) of Chapter 6 of the Statutes of Nova Scotia, 1975, the Beaches Preservation and Protection Act, is pleased to designate as a beach an area of land situate at Port Morien, in the County of Cape Breton, lying landward of the mean high watermark and immediately adjacent thereto, the said land being shown outlined in red on the copy of Crown Land Records Office Plan No. E-15-6 marked Schedule “B” and described in Schedule “A”, both Schedules attached to and forming part of the report and recommendation.


Schedule “A”


All that certain area of land lying to the landward and seaward from the mean high watermark of Port Morien Beach, Cape Breton County, Nova Scotia, as shown on Field Plot No. P-066/85 (C.L.R. No. E-15-6) signed on the 16th day of January, 1985 by Wayne D. Hardy, Nova Scotia Land Surveyor and filed in the Department of Lands and Forests Office, Halifax and being more particularly described as follows:


Beginning at Survey Marker Number C.B. 3407 being by Grid Azimuth (based on the Nova Scotia 3° Transverse Mercator Projection, Zone 4, Central Meridian at 61° 30' west longitude) 210° 26' 51" at a distance of 1791.97 feet from Nova Scotia Co-ordinate Monument Number 1861 and also being 305° 39' 07" at a distance of 45 feet more or less from the mean high watermark on the northern shore of Morien Bay;


Thence 305° 39' 07", a distance of 21 feet more or less to the southern boundary of the public highway leading from Glace Bay to Catalone Road;


Thence southwesterly along the southern boundary of the said road, a distance of 700 feet more or less to a point on the mean high watermark on the northern shore of the inner bay of Morien Bay;


Thence southwesterly along the mean high watermark on the northern shore of the said inner bay, a distance of 670 feet more or less to a point, said point being southeasterly at a distance of 4 feet more or less from Survey Marker Number C.B. 3408;


Thence continuing southwesterly along the mean high watermark on the northern shore of the said inner bay, a distance of 5300 feet more or less to a point, said point being 135° 02' 52" at distance of 5 feet more or less from Survey Marker Number C.B. 3409;


Thence continuing 135° 02' 52", crossing the inner bay of Morien Bay a distance of 6460 feet more or less to a point situate on the mean high watermark on the southern shore of the said bay, said point being 315° 02' 52" a distance of 2 feet more or less from Survey Marker C.B. 3410;


Thence northeasterly along the mean high watermark along the southern shore of the said inner bay a distance of 8200 feet more or less to a point;


Thence 40° 45' 10", a distance of 135 feet more or less to Survey Marker Number C.B. 3406;


Thence 305° 39' 07", a distance of 21 feet more or less to a point on the mean high watermark on the southern shore of Morien Bay;


Thence continuing 305° 39' 07", crossing Morien Bay a distance of 6530 feet more or less to a point on the mean high watermark on the northern shore of said Morien Bay;


Thence continuing 305° 39' 07", a distance of 45 feet more or less to Survey Marker Number C.B. 3407 and the place of beginning.
