Beatty Marsh Beach Designation

made under subsection 5(1) of the

Beaches Act

R.S.N.S. 1989, c. 32

O.I.C. 77-121 (February 8, 1977), N.S. Reg. 17/77


The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 7th day of January, A.D., 1977, pursuant to Section 5(1) of Chapter 6 of the Statutes of Nova Scotia, 1975, the Beaches Preservation and Protection Act, is pleased

to designate as a beach an area of land lying landward from the mean high water mark of Beatty Marsh Beach, situate at Malagash Point, in the County of Cumberland, Province of Nova Scotia, as shown outlined in red on the copy of Crown Land Records Office Plan No. E-10-71, marked Schedule “B” and described in Schedule “A”, both attached to and forming part of the report and recommendation.



Schedule “A”


All that certain area of land lying landward from the mean high water mark of Beatty Marsh Beach, situate at Malagash Point, in the County of Cumberland, Province of Nova Scotia as shown outlined in red on the copy of Crown Land Records Office Plan No. E-10-71, attached hereto and being more particularly described as follows:


Beginning at iron survey post # 1 as shown on said Plan No. E-10-71 the said post being situate nineteen feet more or less from the mean high water line of the waters of Northumberland Strait and having coordinates (N 16, 645, 195.45, E 1, 299, 416.17) based on the Nova Scotia Three Degree Transverse Mercator Projection, Zone 5, Central Meridian sixty-four degrees thirty minutes west longitude;


From thence (by grid bearings) south twenty-three degrees fifty-nine minutes nineteen seconds east thirty-one feet to a point;


Thence as shown on said plan following a line which runs parallel to and fifty feet inland from the mean highwater line of the waters of Northumberland Strait or the edge of a Marshland, so-called, easterly, southerly, northerly, easterly and northerly to iron survey post # 4 as shown on said plan, said post # 4 having coordinates (N 16, 648, 085.53, E 1, 304, 767.28);


Thence north forty degrees forty-nine minutes ten seconds west two hundred eighteen decimal seventeen feet to iron survey post # 3 having coordinates (N 16, 648, 250.64, E 1, 304, 624.67) and being situated near the mean highwater line of the waters of Northumberland Strait;


Thence as shown on said plan north forty degrees forty-nine minutes ten seconds west five hundred feet to a point “A” being a calculated point situated in the waters of Northumberland Strait and having coordinates (N 16, 648, 629.03, E 1, 304, 297.83);


Thence as shown on said plan south fifty-nine degrees thirty-nine minutes eighteen seconds west five thousand eight hundred ninety-two decimal nineteen feet to point “B” being a calculated point in the waters of Northumberland Strait and having coordinates (N 16, 645, 652.26, E 1, 299, 212.89);


Thence as shown on said plan south twenty-three degrees fifty-nine minutes nineteen seconds east five hundred feet to the place of beginning.


Excepting and reserving from the above described area of land all the portion thereof lying seaward from the mean high watermark.
