Engine Operators Trade Regulations made under Section 29 of the
Apprenticeship and Trades Qualifications Act

1 In these regulations
(a) "Act" means the Apprenticeship and Trades Qualifications Act;
(b) "Director" means the Director of Apprenticeship and Trades Qualifications;
(c) "Engine Operators Act" means Chapter 89 of the Revised Statutes of Nova Scotia 1967 as amended;
(d) "Engine Operators Board" means the board of examiners appointed under the authority of the Engine Operators Act;
(e) "engine operators trade" or "trade" means the operation and maintaining of various types of stationary engines and mechanical equipment such as boilers, pumps, turbines, compressors, motors and generators to provide heat, power, refrigeration and air conditioning and other utility services for buildings or industrial processes;
(f) "General Regulations" means regulations made by the Governor in Council under authority of the Apprenticeship and Trades Qualifications Act that apply generally to all designated trades.
2 For the purpose of apprenticeship training, the trade shall be divided into four classes in accordance with Part VII, Section 21, subsections (a), (b), (c) and (d) of the regulations under the Engine Operators Act.
3 No person shall enter into a contract of apprenticeship in the trade unless
(a) he/she is sixteen years of age or older; and
(b) he/she possess[es] the following educational qualifications or the equivalent:
(i) for 1st Class - Grade 11 or be the holder of a 2nd Class Engine Operatorís Certificate,
(ii) for 2nd Class - Grade 10 or be the holder of a 3rd Class Engine Operatorís Certificate,
(iii) for 3rd Class and 4th Class - Grade 8; and
(c) his/her physical and mental capabilities are considered sufficient to insure his/her successful completion of the contract.
4 (a) The term of apprenticeship shall be as follows:
(i) First Class - six (6) years
(ii) Second Class - four and one-half (4 1/2) years
(iii) Third and Fourth Class - two (2) years.
(b) No apprenticeship agreement shall be registered which provides for less than Third Class level.
(c) An apprentice shall progress to a higher classification on successful completion of the higher class examinations as administered under the authority vested in the Engine Operators Board.
5 (a) The wage of an apprentice in the trade shall be no less than is prescribed in the wage schedule for the classification which the apprentice has reached in the plant and which is considered as the normal rate for that classification in the plant where the apprentice is employed.
(b) Where a collective agreement between labour and management is in force, the wage rate shall be as indicated by the collective agreement.
6 The Director may grant credits in accordance with Section 4 of the General Regulations provided these have been approved by the Engine Operators Board.
7 Section 13 and Sections 19 through 42 [Section 11 and Sections 18-41] inclusive of the General Regulations do not apply to apprentices or journeymen in the trade.
