Judds Pool Provincial Park Designation

made under Section 8 of the

Provincial Parks Act

The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 9th day of March, A.D., 1983, and pursuant to Section 2 of Chapter 244 of the Revised Statutes of Nova Scotia, 1967, the Provincial Parks Act, is pleased to:

 

                (a)    constitute all that area of land situate at New Chester, in the County of Guysborough, owned by Her Majesty the Queen in right of the Province of Nova Scotia, to be a Provincial Park, the said area of land being described in Schedule “A” and shown outlined in red on the copy of Crown Land Records Plan No. E-13-38 marked Schedule “B”, both Schedules attached to and forming part of the report and recommendation; and

 

                (b)    declare that the Park shall be known by the name of “Judds Pool Provincial Park”.



Schedule “A”


All that certain lot, piece or parcel of land situate, lying and being at New Chester, in the County of Guysborough, Province of Nova Scotia as shown on Plan Number E-13-38 filed in the Crown Land Records Office, Department of Lands and Forests, Halifax, the said land being more particularly described as follows:


Beginning at a point at the southeastern angle of Crown Grant Number 22235 to Judson Bezanson, said point being on the western boundary of the Ecum Secum River and being distant N 68° 49' 50" E, 7 feet more or less from Survey Monument (S.M.) Number 7576;


Thence following the various courses of the western and southwestern boundary of the said Ecum Secum River, downstream, at ordinary high water mark in a southerly and southeasterly direction, 4000 feet more or less to the northwestern boundary of Crown Grant Number 19502 to A. Turner;


Thence S 54° 12' 55" W (by astronomic bearings referred to the meridian passing through S.M. Number 1065 and derived from solar observations taken at S.M. Number 1065), 13 feet more or less following the northwestern boundary of Crown Grant Number 19502 to S.M. Number 1129 and being distant S 50° 00' 05" E, 3361.04 feet from aforementioned S.M. Number 7576;


Thence continuing S 54° 12' 55" W, 556.38 feet along the northwestern boundary of Crown Grant Number 19502 and crossing the public highway from Route No. 7 to New Chester, to S.M. Number 1057 being at the northwestern angle of aforesaid Crown Grant Number 19502;


Thence S 68° 05' 15" W, 3771.40 feet following a northern boundary of Crown Land to S.M. Number G-10000;


Thence N 21° 55' 00" W, 2514.40 feet following an eastern boundary of Crown Land to S.M. Number G-10001, being on the southern boundary of aforementioned Crown Grant Number 22235;


Thence N 68° 05' 00" E, 1979.98 feet following a southern boundary of Crown Grant Number 22235 to S.M. Number 1065;


Thence N 21° 21' 45" W, 592.18 feet following an eastern boundary of aforesaid Crown Grant Number 22235 to S.M. Number 7574;


Thence N 68° 45' 35" E, 551.99 feet following a southern boundary of aforesaid Crown Grant Number 22235 and crossing a portion of the aforementioned public highway from Route No. 7 to New Chester, to a point;


Thence N 68° 49' 50" E, 14.51 feet following the aforesaid southern boundary of Crown Grant Number 22235 and crossing the remaining portion of the aforesaid public highway to S.M. Number 7575A;


Thence continuing along the last aforementioned southern boundary of Crown Grant Number 22235, N 68° 49' 50" E, 175.96 feet to S.M. Number 7576;


Thence continuing N 68° 49' 0" E, 7 feet more or less to the place of beginning, containing 198 acres more or less excluding the public highway.


Excepting and reserving that portion of public highway leading from Route No. 7 to New Chester that passes through the above described land.

The Governor in Council on the report and recommendation of the Minister of Natural Resources dated the 16th day of October, A.D., 1992, pursuant to Section 8(a) and (b) of Chapter 367 of the Revised Statutes of Nova Scotia, 1989, the Provincial Parks Act, is pleased to decrease by a total of 1.454 hectares the size of Judds Pool Provincial Park, in the County of Guysborough, so constituted by Order in Council 83-372 dated the 5th day of April, A.D., 1983, by approving the withdrawal from the park of approximately 1.947 hectares of Crown land shown outlined in red on the plans marked Schedule “A” and “B”, attached to and forming part of the report and recommendation, for the purpose of realigning the New Chester Road, and by designating approximately 0.493 hectares of Crown land shown outlined in green on Schedule “B” as part of Judds Pool Provincial Park, and to authorize the Minister of Natural Resources to execute such documents as may be necessary to achieve the purposes of this Order.
