Exemption from Examination and Licensing Regulations

made under subsection 65(6) of the

Motor Vehicle Act

R.S.N.S. 1989, c. 293

Citation

1     These regulations may be cited as the Exemption from Examination and Licensing Regulations.


Definitions

2     In these regulations,

 

                (a)    “Act” means the Motor Vehicle Act;

 

                (b)    “home country” of a person means the country in which the person has citizenship;

 

                (c)    “international driving permit” means a permit issued by a foreign country under the terms of the United Nations 1949 Convention on Road Traffic attesting that the permit holder possesses a valid driver’s license issued by a competent authority in the permit holder’s home country;

 

                (d)    “work permit” means a permit issued by Citizenship and Immigration Canada under the Immigration and Refugee [Protection] Act [(Canada)] that allows a person to work in Nova Scotia for a specified period of time.


Exemption for seasonal agricultural workers

3     (1)    A resident may drive on a highway in the Province without a driving examination or a driver’s license issued under the Act if the resident

 

                (a)    is a citizen of

 

                         (i)     Barbados,

 

                         (ii)    Jamaica, or

 

                         (iii)   Mexico;

 

                (b)    is residing in Canada under a work permit and is employed to work on a farm in the Province;

 

                (c)    has been issued a driver’s license from their home country, and the driver’s license has not been revoked or suspended;

 

                (d)    is at least 16 years old; and

 

                (e)    has in their possession an international driving permit that was issued within the previous 12 months by their home country.

 

       (2)    A resident exempted by this Section from the requirements for a driving examination and a driver’s license may drive only a motor vehicle of the class specified on their international driving permit.


Suspension or revocation

4     A resident whose privilege of obtaining a driver’s license has been revoked or suspended under the Act is not entitled to rely on any exemption in these regulations.
