Classes of Vehicles to be Inspected at Official Testing Stations Regulations

made under subsection 201(3) of the

Motor Vehicle Act

Citation

1     These regulations may be cited as the Classes of Vehicles to be Inspected at Official Testing Stations Regulations.


Definitions

2     In these regulations,

 

                (a)    “Act” means the Motor Vehicle Act, unless the context otherwise requires;

 

                (b)    “new vehicle” means a vehicle that has never been registered in any jurisdiction and that has been sold to its owner by a licensed dealer in the Province;

 

                (c)    Vehicle Inspection Regulations” means the Vehicle Inspection Regulations made under the Act.


Classes of vehicles to be tested biannually

3     (1)    Except as provided in subsection (2) or subsection (3), a vehicle in any of the following classes of vehicles must be inspected biannually at an official testing station:

                (a)    passenger motor vehicles, except taxicabs;

 

                (b)    trucks and vans that have a registered gross vehicle weight less than 4501 kg;

 

                (c)    implements of husbandry that are not required to display a slow-moving [vehicle] sign as prescribed under the Act;

 

                (d)    motorcycles;

 

                (e)    motor-driven cycles;

 

                (f)    trailers that have a registered gross vehicle weight less than 4501 kg; and

 

                (g)    motor vehicles designed or reconstructed, equipped and used or intended to be used primarily for sleeping, eating and living quarters, including motorized homes or buses converted for such purposes.

 

       (2)    A new vehicle in any of the classes listed in subsection (1) that has had a pre-delivery inspection in accordance with the Vehicle Inspection Regulations is not required to be inspected until 3 years after the date of the pre-delivery inspection.

 

       (3)    A new vehicle of a class described in subsection (1) does not require an inspection while:

 

                (a)    the vehicle is being driven off a vehicle transporter to a vehicle storage facility owned or operated by a dealer; or

 

                (b)    the vehicle is being driven from a vehicle storage facility owned or operated by a dealer to the same dealer’s licensed premises for the purpose of an inspection under the Vehicle Inspection Regulations.

       (4)    Notwithstanding anything in these regulations, a vehicle that is exempt from registration under the Act or any regulations made under the Act is exempt from inspection requirements under the Vehicle Inspection Regulations.

Classes of vehicles to be tested annually

4     A vehicle in any of the following classes of vehicles must be inspected annually at an official testing station:

 

                (a)    trucks and truck tractors that have a registered gross vehicle weight of 4501 kg

or more;

                (b)    trailers that have a registered gross vehicle weight of 4501 kg or more;

(c) ambulances;

                (d)    hearses;

                (e)    motor vehicle service, repair or towing trucks;

(f)taxicabs;

                (g)    fire department vehicles;

                (h)    buses not licensed as public passenger vehicles under the Motor Carrier Act, except buses that are passenger vehicles as defined in subsection 2(h) of that

Act; and

                (i)     vehicles that have permanently mounted equipment on a truck or truck tractor chassis, such as a crane, a lifting device or well-drilling or other miscellaneous equipment.


Classes of vehicles that do not require inspection

5     The following classes of vehicles do not require an inspection:

 

                (a)    antique vehicles;

                (b)    mobile homes being towed to retail sales outlets or to permanent locations; and

                (c)    vehicles that are required to display a slow-moving vehicle sign as prescribed under the Act.


Validity period for approval sticker

6     (1)    An approval sticker issued under the Vehicle Inspection Regulations for a vehicle that requires a biannual inspection is valid for 2 years from the end of the month of its issue.

 

       (2)    An approval sticker issued under the Vehicle Inspection Regulations for a vehicle that requires an annual inspection is valid for 1 year from the end of the month of its issue.
