Citation

1        These regulations may be cited as the Guide Regulations.


Definition

2        (1)    In these regulations

 

                   (a)      “Act” means the Wildlife Act;

 

                   (b)     “Department” means the Department of Natural Resources;

 

                   (c)      [repealed]

 

                   (d)     “Minister” means the Minister of Natural Resources;

 

                   (e)      “registered guide” means a guide licensed under these regulations but does not include the holder of a special permit to guide;

 

                   (f)      “registered guide licence” means a Registered Fishing Guide Licence, Registered Hunting Guide Licence, and Registered Master Guide Licence;

 

                   (g)     “Registered Fishing Guide Licence” means a licence issued pursuant to the Act and regulations conferring upon the holder the privilege of accompanying as a registered guide any person fishing or intending to fish;

 

                   (h)     “Registered Hunting Guide Licence” means a licence issued pursuant to the Act and regulations conferring upon the holder the privilege of accompanying in the woods as a registered guide any person hunting wildlife or intending to hunt wildlife;

 

                   (i)      [repealed]

 

                   (j)      “Registered Master Guide Licence” means a licence issued pursuant to the Act and regulations conferring upon the holder the privilege of accompanying in the woods as a registered guide any person hunting wildlife, fishing or intending to hunt wildlife or fish;

 

                   (k)     [repealed]

 

                   (l)      “special permit to guide” means a permit issued under this Act to a person conferring upon the holder the privilege of accompanying in the woods as a guide any friends or relatives who wish to hunt or fish or who intend to hunt or fish.


Types of licence/fee

3        (1)    The Minister may

 

                   (a)      issue a Registered Fishing Guide Licence, a Registered Hunting Guide Licence, a Registered Master Guide Licence, or a combination of two or more of the licences at a fee of $12.48 for each licence or combination of licences;

 

                   (b)     issue a Special Permit to Guide for a fee of $6.22.

 

          (2)    Provided there has been compliance with the Act and regulations, a registered guide may apply for a renewal of a registered guide licence upon the payment of the prescribed fee.

 

          (3)    A registered guide licence issued pursuant to these regulations expires annually on March 31.

 

          (4)    No special permit to guide is valid unless the applicant is a resident, provides answers to all the questions provided on the permit, and complies with all the other terms and conditions provided on the permit.

 

          (5)    No person shall apply for, be granted, or hold a registered guide licence or a special permit to guide

 

                   (a)      during the period of suspension or cancellation if the person’s privilege of obtaining a hunting or fishing licence pursuant to the Act is suspended or cancelled;

 

                   (b)     for a period of one year from the date of conviction if the person is convicted of an offence pursuant to Section 8 of these regulations.


Qualifications

4        (1)    A person 16 years of age and over may apply for a registered guide licence provided that the person has successfully passed a competency test as prescribed by the Minister.

 

          (1A) A person under 19 years of age who holds a registered guide licence may only act as a guide under the supervision of a registered guide who is 19 years of age and over.

 

          (2)    A resident nineteen years of age and over may apply for a special permit to guide if the person is certified to hunt with a firearm or bow under the Hunter Education, Safety and Training Regulations made under the Act.

 

          (3)    The holder of a special permit to guide shall not charge a fee or accept compensation or reward when acting pursuant to a special permit to guide.


Non-residents

5        (1)    It shall be an offence for a non-resident to hunt, take or kill wildlife or attempt to hunt, take or kill wildlife without being supervised by a registered guide or a resident who holds a special permit to guide.

 

          (2)    Where, in the opinion of the Minister, guide services are not reasonably available, the Minister may authorize a non-resident to hunt for a specified period of time and at a specific location within the Province while not accompanied by a guide.

Guide examination boards

7        (1)    The Minister shall institute a competency test for persons who apply to be licensed as a registered guide.

 

          (2)    The Minister may designate persons to determine, subject to the approval of the Minister, the content of the competency test and to administer the testing referred to in subsection (1).

 

          (3)    Except with the permission of the Minister, no person under 12 years old shall be permitted to take a guide course or competency test.

 

          (4)    [repealed]

 

          (5)    The competency test may be taken by the applicant orally or in writing.

 

          (6)    The Minister shall establish the pass mark for the competency test.

 

          (7)    [repealed]


Guiding methods

8        No registered guide or person who holds a special permit to guide shall at any one time

 

                   (a)      guide more than three persons when guiding persons who are hunting for deer;

 

                   (b)     guide more than four persons when guiding persons who are hunting or fishing species other than deer.


Information returns

9        (1)    Every person to whom a Guide Licence or Special Permit to Guide has been issued shall send to the Minister by post any report card or information report required by the Minister.

 

          (2)    Where a person is the holder of a Registered Guide Licence or Special Permit to Guide and acts as a guide for a non-resident, the person shall collect from the non-resident and submit to the Minister such information returns and biological parts of wildlife as required to be submitted pursuant to the terms of the non-resident's licence.


Terms/conditions of licence

10      It shall be an offence for any person to contravene the terms or conditions contained in the registered guide licence or special permit to guide.

 

11      [repealed]


Repeal of old regulations

12      Regulations made by Order in Council 83-801 dated the 26th day of July, 1983, as amended, respecting guides are rescinded as of the 29th day of September, 1987.


Effective date of new regulations

13      These regulations shall come into force on and after the 29th day of September, 1987.
